Terms and Conditions
1. General
By accessing this App operated by START Hack, you declare that you have understood and accept the following terms and conditions. By registering for a hackathon organized by START Hack or using this App all participants agree to comply with and be bound by these terms and conditions. START Hack reserves the right to modify or remove these terms and conditions, as well as any related information, at any time, to any extent, and without prior notice.
2. Data Privacy Protection
2.1 The parties recognize that START Hack is organizing hackathons, which live on the names of its participants. Appropriate to this fact, START Global is allowed to publish and further process retrievable public data as well as the data of every user provided within the context of the registration. The user agrees to receive both written and electronic newsletters and other information from START Hack. Cancellation of data usage is enabled through email notification (info@startglobal.org).
2.2 In order to access START Hack you may be required to upload your CV to the online event platform. By uploading your CV, you agree that START Hack may share your CV or other personal information given with its partners.
3. Non-disclosure Agreement
„Confidential Information” shall mean any oral, written, visual, and/or other tangible forms of information, material or know-how regarding any data, process, business plan, specifications, technique, program, business information or other proprietary information relating to START Hack. Every contractual partner of START Hack (including every registered User) shall hold in confidence the Confidential Information and shall not disclose such information to any third party, even under a respective secrecy agreement between the contractual partner of START Hack and such third party, and shall not use such information for its own benefit or the benefit of any third party without the prior written consent of START Hack.
4. Liability
4.1 START Hack will not be liable for any loss, injury or damage to any person or property howsoever caused during the START Hack event. Each participant must make provision for his or her own insurance.
4.2 Note that START Hack has the right to disqualify the participant from the Event at any time in its sole discretion for example due to inappropriate behaviour at the Event, breach of the rules of the Event or these Terms, or due to the wish of START Hack. START Hack is not responsible for any damage or inconvenience caused by the disqualification of a participant.
4.3 By participating in the Event, Participants acknowledge that the Event will be recorded for reference and similar use, and therefore they grant START Hack a worldwide, perpetual, irrevocable, sublicensable and non-exclusive license to display their work performed at the Event for promotional and marketing purposes of START Hack, for example in blog posts, online videos or case descriptions. Participants understand that they will not receive any royalty or compensation for this use of their work by START Hack.
4.4 By attending the Event, Participants consent to being filmed and/or photographed at the Event. Furthermore, Participants consents to any such footage to be published in START Hack’s and/or a third party’s, as the case may be, marketing and communication channels without the Participant’s review or approval and without compensation at any time.
5. START Hack Event
5.1 In connection with the participation in the Event, participants shall provide accurate and complete information to START Hack as requested by START Hack.
5.2 START Hack has the right at its sole discretion to require an application and determine the participants of each Event among the applicants. Such a decision by START Hack cannot be appealed. START Hack also has the right to accept a formerly rejected applicant’s participation in the Event at its sole discretion by informing such applicant thereof.
5.3 START Hack or a jury chosen by START Hack may choose a winner or winners among the work products (“Submission”) created and developed in the Event by the participants. The selection of the winner(s) of the Event shall at all times be final and cannot be appealed. If participants accept a prize for winning the Event, they are solely responsible for all applicable taxes related to accepting such prize.
5.4 If participating in the Event, participants must comply with the following rules:

They must adhere to these Terms and any additional rules stated at the beginning of the Event by START Hack;

They must have read and agreed to the Code of Conduct;

Their Submission shall not contain any viruses, Trojan horses, worms, harmful code or any other element that is malicious or damaged;

Their Submission shall not contain any content that violates any law or any third-party rights (including privacy and intellectual property rights), unless they are the owner of such rights or have permission or license to use such content in their Submission in the Event in accordance with these Terms.
5.5 All Submissions and other work performed at the Event remain the intellectual property of the individuals or entities that have developed them. START Hack makes no claim to any intellectual property developed during the course of the event, except as otherwise provided herein. However, Participant hereby grants START Hack and its business partners a worldwide, perpetual, irrevocable, sub-licensable and non-exclusive license to use information relating to the Submission provided by the participant on the submission platform for promotional and marketing purposes of START Hack and its business partners. Participants understand that they will not receive any royalty or compensation for this use of the Submission by START Hack.
5.6 START Hack may provide the participants of the Event with technical challenges (=cases) and resources/materials to be worked within the Event.
5.7 If the corporate partner providing the case supplies hardware for its processing, the supplied hardware must be returned at the end of the Hackathon.
5.8 The corporate partner who has provided the case processed by the participant shall receive a two-week right of first refusal for the source codes and software developed by the participants.
6. Miscellaneous
6.1 Should one or more provisions of these terms and conditions be deemed invalid in whole or in part, this shall not affect the validity of the remaining provisions hereof.
6.2 These terms and conditions and all contractual relationships with START Global shall be governed exclusively by Swiss law unless otherwise contracted. The jurisdiction for all disputes arising from or in connection with this contract is St. Gallen, Switzerland. Contract language is English or German.
6.3 We may, at any time, and at our sole discretion, modify these Terms and Conditions, including our Privacy Policy, with or without notice to the User. Any such modification will be effective immediately upon public posting. Your continued use of our Service and this App following any such modification constitutes your acceptance of these modified Terms.
Privacy Policy
This Privacy Policy governs the manner in which START Hack collects, uses, maintains and discloses information collected from users (each, a “User”) of the START Hack App (“App”).
We process personal data in accordance with the Swiss Federal Act on Data Protection and, where applicable, the EU General Data Protection Regulation. The legal basis for the processing of your personal data is our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR. This Privacy Policy outlines the purposes for which we might collect and use your personal data and what your associated rights are. We may provide you with additional supplementary privacy policies if we consider it useful.
WHAT INFORMATION WE COLLECT AND PROCESS
To organize and conduct the START Hack event, we collect and process personal data about participants. This includes information provided when you register for an event, interact with us during the event, or communicate with us beforehand. We may collect personal identification information such as email, date of birth, gender, educational and professional status, and skills. Additionally, we may gather information related to your participation, such as the number of hackathons you have participated in and the years of participation.
In some cases, we may also process sensitive personal data (e.g., dietary requirements, nationality). Whenever necessary, we will seek your explicit consent before processing such data. Please note that providing certain personal information may be necessary for participating in event-related activities. However, you can choose to limit the information you provide, which may restrict your ability to engage in specific aspects of the event.
Additionally, we collect and process the following personal data about applicants to our formats and programs: t-shirt size and application documents (e.g. CV, motivation letter).
Furthermore, photographs and video recordings will be made at START Hack. These will be used for public relations work (including social media) and will also serve to permanently document the events (offline and online and can thus also be accessed outside Europe).
Finally our server temporarily saves information about your use of our App. Such information includes, among other things, the IP address, date and time of access, the operating system (including the version) of the computer used and the name of the user’s access provider. We may collect non-personal identification information about Users whenever they interact with our App. Non-personal identification information may include the type of computer and technical information about Users’ means of connection to our App, such as the operating system and the Internet service providers utilized and other similar information.
WEB BROWSER COOKIES
Our App may use "Cookies" to enhance the User experience. Cookies are stored on the User’s device and are used, among other things, to save preferences or track information about App usage. Users can adjust their App settings to refuse cookies. However, please note that some features of the App may not function properly if cookies are disabled.
WHY WE COLLECT PERSONAL DATA
START Hack’s legal basis for the processing of your personal data is our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR. START Hack may collect and use Users-personal information for the following purposes:
To run and operate our event, we may need your information to ensure a seamless and personalized event experience and to display content on our App correctly.

To ensure safety and security, we use your information to verify identities, monitor for suspicious or fraudulent activities, and ensure compliance with our event policies.

To analyze and improve our events, we may use aggregated data to understand how participants engage with our programs and formats, helping us enhance the quality and relevance of future events.

To protect our legitimate business interests and legal rights, we may use your information as required by law or to safeguard our legal and regulatory obligations.

To control applications: Whenever you apply to the Hackathon you are obligated to share certain personal data to us. By submitting your application, you make it possible for us to use and examine that information so that we can invite you to the event.
We do not share this information with outside parties except to the extent necessary to provide the service. To send periodic emails we may use the email address to send User information and updates pertaining to their order. It may also be used to respond to their inquiries, questions, and/or other requests.
HOW WE PROTECT YOUR INFORMATION
We implement robust data collection, storage, and processing practices, along with advanced security measures, to safeguard your personal information against unauthorized access, alteration, disclosure, or destruction. Authentication is managed through Firestore Authentication, a highly secure solution provided by Google. Additionally, we utilize APIs to connect with third-party providers for purposes such as mailing and data collection.
SHARING YOUR PERSONAL INFORMATION
We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the App or administer activities on our behalf, such as sending out newsletters or surveys. We may store your information with these third parties for those limited purposes.

Please note that START Hack reserves the right to assert the restrictions provided for by law, for example if it is obliged to retain or process certain data, has an overriding interest in doing so (as far as it is entitled to rely on this) or if it is required for the assertion of claims.
START Hack may support the rights of data subjects vis-à-vis third parties to the extent that this is objectively possible.
THIRD PARTY WEBSITES
Users may find advertising or other content on our App that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our App. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own Privacy Policy and customer service policies.
ELECTRONIC NEWSLETTERS
If a User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. We may use third party service providers to help us operate our business and the App or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission. You can unsubscribe at any time.
ADVERTISING
Ads appearing on our App may be delivered to Users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile non-personal identification information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy does not cover the use of cookies by any advertisers. You may learn more about opting out of major ad networks.
GOOGLE ADSENSE
Some of the ads may be served by Google. Google’s use of the DART cookie enables it to serve ads to Users based on their visit to our App. DART uses “non personally identifiable information” and does NOT track personal information about you, such as your name, email address, physical address, etc. You may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.
PRIVACY POLICY FOR THE USE OF GOOGLE ANALYTICS AND ADWORDS
We use a tool called Google Analytics. This tool uses so-called „cookies”, text files which are being stored on your computer and enable the analysis of your usage of the app. Only you can prevent your browser software from storing cookies. In order to do this, you have to change your settings although some features will be deactivated.
PRIVACY POLICY FOR THE USE OF SENTRY
Our game integrates with Sentry to monitor errors and performance issues. This helps us identify and resolve problems to enhance the player experience. PRIVACY POLICY FOR THE USE OF WHATSAPP
We offer you the option of contacting us via WhatsApp. If you use this channel, we will process your name, telephone number and other data you provide. The data is processed in order to answer your enquiry or, if you have expressly consented (marketing opt-in), to send you promotional messages.
WhatsApp processes the data in accordance with its privacy policy. The communication content is end-to-end encrypted. WhatsApp may also collect other so-called metadata, which may contain information about the identity of the sender and recipient, as well as device information, telephone number and information about the use of WhatsApp (e.g. duration and frequency). WhatsApp also uses this data for its own purposes, such as improving the WhatsApp service.
Further information can be found in the WhatsApp privacy policy. We have no knowledge of the details of this data processing and have no influence on it.
Alternatively, your data will be deleted as soon as the purpose of the processing no longer applies and, in the case of statutory retention periods, the data will be blocked for further use until the retention period has expired.
DATA THEFT PROHIBITION
Unauthorized theft or extraction of any data, including contact information, for monetary gain or other illicit purposes is strictly prohibited on our platform. We enforce security measures and reserve the right to take legal action against offenders. By using our services, you agree to respect user privacy and refrain from data theft activities.
DURATION OF DATA STORAGE
Once the legal basis for data processing ceases to exist or the collected data no longer serves the pursuit of a specific purpose of START Hack, it will be deleted, unless there are legal or contractual reasons against the deletion. On your request you have cancelled your consent via email, all data connected to you will be deleted or anonymized. We also store your personal data to comply with our various statutory and regulatory obligations of documentation and record-keeping. Personal data of applicants to the START Hack Event to whom we cannot offer a position will be deleted six months after cancellation at the latest. With the consent of applicants, we may store the collected personal data for a longer period to offer the applicant any other positions at our organization.
CHANGES TO THIS PRIVACY POLICY
START Hack has the discretion to update this Privacy Policy at any time. When we do, we will post a notification on our App. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and become aware of modifications.
YOUR ACCEPTANCE OF THESE TERMS
By using this App, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our App. Your continued use of the App following the posting of changes to this policy will be deemed your acceptance of those changes.
